I am convinced. My name is not Nicole.




Victorina originally planned to write an article dissecting the motivations of Nicole for recanting. We heard stories of the 100K cash gift to the family. We know of the feminist interpretation of this as part of the conspiracy by Malacanang. Yet, we also heard rumors that in fact she was a prostitute who saw a golden opportunity.

However, we decided not to tell you our story of Nicole. Instead, we will let Nicole tell her story. This is from her sworn testimony. We trust that our readers will share their points of view. We will also share ours.

What to make out of the story of Nicole?

Deep inside, however, I know that I may never be able to move on for as long as I continue to search for answers to so many questions that have lingered in my mind regarding the incident in Subic more that three years ago. Daniel Smith was convicted of rape because the court accepted my version that he took advantage of my intoxication i raping me inside a van that took us to the seawall located at the SBMA Alaba Pier at around 11:30 in the evening of November 1, 2005.

1. Daniel Smith's witnesses said that while we were at the Neptune Club, I sat on Daniel Smith's lap and that we kissed each other passionately. I remember that before I met Daniel Smith at the Neptune Club, all I ate was a slice of pizza at the Grand Leisure Hotel. After the pizza, everything else was alcohol drinks from vodka sprite, B52, Singaporean sling, B53, long island ice tea to bullfrog all of which I drank bottoms up. I do not recall Daniel Smith having ordered any alcoholic drink for me. My drinks were all paid for by Chris Mills who invited me to go to the Neptune Club.

2. I had no opportunity to deny in court that I kissed Daniel Smith but with the amount of alcoholic mixed drinks I took, my low tolerance level for alcohol and with only a slice of pizza all night, it dawned upon me that I may have possibly lost my inhibitions, became so intimate with Daniel Smith and did more than just dancing and talking with him like everyone else on the dance floor. Looking back, I would not have agreed to talk with Daniel Smith and dance with him no less than three times if I did not enjoy his company or was at least attracted to him since I met him for the very first time on the dance floor of Neptune Club.

3. When I danced with Daniel Smith for the third time, my companions, Chris Mills has already left Neptune Club since they had to catch their curfew time at the military base. The lighting was sufficient for people to recognize each other and other marines were with their Filipino partners drinking, dancing, and enjoying each other's company and kissing and hugging among partners was a common scene.

4. With the events at the Neptune Club in mind, I keep on asking myself, if Daniel Smith wanted to rape me, why would he carry me out of the Neptune Club using the main entrance in full view of the security guard and the other customers? Why would the van park right in front of Neptune Club? Why would Daniel Smith and his companies bring me to the seawall of Alaba pier and casually leave this area that was well lighted and with many people roaming around? If they believed that I was raped, would they have not dumped me instead in a dimly lit area along the highway going to Alaba pier to avoid detection?

5. I told the court that Daniel Smith kissed my lips and neck and held my breast inside the van. Recalling my testimony, I ask myself how I could have remembered this if witnesses told the court that I passed out and looked unconscious when I was brought to the van by Daniel Smith. How could I have resisted his advances given this condition? Daniel Smith and I were alone on the third row of the van which had limited space and I do not recall anyone inside the van who held my hand or any part of my body. What I can recall is that there was very loud music and shouting inside the van.

6. If the travel from Neptune Club took only several minutes and with the driver of the van trying to beat the curfew time of his passengers, how could I have instantly regained my consciousness and talked to the people upon reaching the seawall of Alaba Pier? When people gathered around me at the seawall, everyone seemed to have drawn the conclusion that I was raped except for one who called me a bitch.

7. Based on the account of the SBMA police, I was very hesitant to board the mobile police car that brought me to the headquarters for investigation. I was so confused and the first thing that entered my mind was how would my mother and boyfriend react if they learn that I was last seen with Daniel Smith and that a condom was seen on my pants after Daniel Smith left the van? I was scared of losing not only my American boyfriend but the chance of living in the United States. In fact, I did not immediately tell my boyfriend that I was raped by Daniel Smith. All I said was that something bad happened to me.

8. I expect many sectors to question my motives in executing this statement more than three years after the incident. However, as I practically grew up interacting with American servicemen in Zamboanga City who treated me and my family very well, and thinking over and over again how I may have conducted myself at the Neptune Club, I can't help but entertain doubts on whether the sequence of events in Subic last November of 2005 really occurred the way the court found them to have happened.

9. My conscience continues to bother me realizing that I may have in fact been so friendly and intimate with Daniel Smith at the Neptune Club that he was led to believe that I was amenable to having sex or that we simply just got carried away. I would rather risk public outrage than do nothing to help the court in ensuring that justice is served.

The fact that she got some cash and a visa to the U.S. will no doubt be suspect to some people. The sad part about this of course is that the next person who cries rape will have to work so much harder to be believed (even by pinoys).

    IF a woman is drunk she is therefore legally incapacitated to consent any sexual activity (not sure if this applies in Philippine law). I think she's suffering from "blame the victim" syndrome, ever since the story broke, a lot of Filipinos has spoken out about how "she presented herself to be raped". I don't see her statement as recantation at all. Her statements has just proven how the event damages her emotionally and psychologically. Sexual abuse victims has always and will always eventually put the blame to themselves. What more with Nicole who was born and raised in the Philippines, where being raped is already a social no no, and being raped at a place where practically every woman is perceived as a whore? I can't imagine how painful it is to be her.

    Pangilinan is correct, it wasn't her who failed us, it was the Philippines Justice system that failed her and us (it's been 3 years, from where Smith is, conviction and including exhaustion of all legal procedure just take months). Add to that is the government who approved of the clandestine transfer of Smith from city jail to the US embassy. Now tell me, how do you think Nicole felt when all these was unveiling right before her eyes? With fellow Filipinos calling her a whore and the apparent lack or support from her own government, I would lose hope as well and would just want to forget it and leave the country and leave Filipinos to be screwed by their own government. At least she has a brighter future elsewhere.

    When the story broke out, I was skeptical that "SUZETTE" aka Nicole was indeed raped. There were so many inconsistencies in her story.

    What's sad is that SHE WAS USED by media hungry individuals and made it a national issue. Now she recants. In my opinion, aside from monetary and VISA considerations, I believe that guilt has caught up with her. She is tired from being manipulated yet again by the same people bent on using her FOR THEIR GAIN.

    This was way worse than being actually raped, for the victims became the whole nation and we were all taken for a ride. And as a secondary note, I believe no rape ever occurred. Was there consensual SEX? She charged three servicemen with rape and won didn't she.

    I am not siding with Smith. But may this serve as a warning to all.

    I believe that when girls get raped in a bar/club it's partly their fault. There are precautions to avoiding this (i.e. clubbing with people you can trust, NOT clubbing alone, NOT getting in a van with complete strangers when you're under the influence of alcohol)and clearly that Nicole DID NOT observe these.

    i think it is already too late to be lambasting nicole for what she had done. was she really raped, who knows? did she get monetary compensation to do another affidavit, who knows? that fact of the matter is, those who thought that nicole was lying kept it to themselves and were silent.

    however, i do think that we should look at our legal system closely on how it failed to protect the innocent, if ever he really is, regardless of nationality.

    as for heckling the lawyers, it was their duty to do what's best for their client and i think this just shows how great they were, regardless if their client was raped or not. i think most of us would want our lawyers to exhaust every means to get the results we want. it was their job and they did it well.

    nonetheless, i applaud (not to be mistaken for admiration) nicole for making the new affidavit knowing fully well that she will be subjected to "public outrage". its one thing to lie and another to admit to lying.

    and as for daniel smith and for the other daniel smiths out there, keep it in your pants and no one gets hurt.

    to my fellow filipinas, don't ever forget that no means NO. never hesitate to cry rape. we are not defined by the wrongdoing of one person.

    It was, in the parlance of negotiators, a lose-lose situation. Nicole, the woman raped by American serviceman Daniel Smith, the woman whose face the Inquirer bared cruelly on its front pages today, knew what awaited her.

    And she was right. The insults, the slurs, the indignation rained as heavy as they did when PR hacks hired for the defense of Smith (and the government he serves) tried to justify a crime by painting Nicole as a woman of loose morals.

    That Nicole practically damns herself the same way now does not excuse the stone throwing.

    A woman of loose morals can be raped. Indeed, a woman seen by society as one with loose morals is most vulnerable to rape. A society that fumes at a woman’s attempt to live by her own rules will turn its eyes away and close its ears when men decide to impose the most humiliating punishment they can on this singular, defiant woman.

    There’s a line in the Green Mile. To paraphrase: people who think themselves enlightened can perpetrate the most horrific deeds. By commission they do this; likewise, by omission.

    Like many friends, I, too, would like to see a lopsided, onerous treaty provided rescinded. A country may open its doors to troops of a military ally if it helps build up its own defense capabilities; what makes the VFA unjust are the provisions clearly skewed towards the bigger power. Until the VFA treats erring American troops like erring Filipino troops, it remains unacceptable. (One might point out that too many erring Filipino soldiers have walked away scot-free but we can’t have everything and just a slight evening out of the field is enough for me.)

    But yearning for a noble goal – abolition of an onerous treaty – does not mean it is right for us to drag Nicole through the mud once more. There is no more self-serving, selfish comment than to wail we’ve been had because Nicole issued an affidavit virtually clearing Smith.

    So she crumbled. So she groveled before might and the power of the American dream. So what? A close reading of the affidavit shows she doesn’t say the rape NEVER happened. She just spouts what the defense wants her to say.

    Many raped women have crumbled in the face of much, much less – say, the tears of an apologetic husband or boyfriend, or the pleas of a family tired of braving the sneers and leers, or just the mounting bills of a legal battle; or maybe just the pleas of one man’s mother, and/or the promise of marriage to make an “honest” woman of her — with all the subtext of she-was-asking-for-it.

    We in the media and people’s organizations know of tortured folk recanting on earlier testimony. It doesn’t make them allies of evil men; it simply means there were factors heavy enough to crush determination and courage.

    Was it naĆÆve of Nicole to expect aid from the Philippine government? Maybe. But many Filipinos do expect government or government officials to help them. Why are there long lines of supplicants at the gates of mayors and congressmen and governors?

    Besides, it’s not just the government. People’s orgs and NGOs – even the media – are there to succor the afflicted. But our attention spans are also as short as the public’s. We are not evil; we just have other, “more important” things to attend to.

    How many times have we in media done a round of mea culpa when discussing human rights? We admit we cannot always keep the lights shining on one particular case – and that often starts the slide to defeat. That does not make us in the media bad; we know the many reasons for this situation. If we can accept this, why cannot we accept the loneliness and bewilderment of the violated, their impatience and their hopelessness?

    Likewise, I have been around these circles of aid-givers enough to know that there is some residual middle-class desire to expect people we help to be docile and grateful, when in truth the task of working for justice does not guarantee good manners and right conduct among those we seek to aid.

    Oh yes, there are many do-gooders who can barely mask their pinched noses as they go about giving aid, and there are those whose faces turn red and mouths turn down when they are met with less than obsequious thanks in their tours of duty or because the people they help just can’t be bothered by the higher isms of the day. That’s not to denigrate aid givers as evil; just to make them out as truly human, the same way the people they serve, Nicole included, are just as human.

    The truth is, Nicole has walked a long, long way in this ordeal; longer than most women who have suffered rape.

    Just a little over a week ago, I had to double check some documents from the Bacolod police because they initially seemed exaggeratedly negative. Of 36 cases of acts of lasciviousness report last year, only six were filed with the fiscal. Of 943 cases of violence against women, only 13 were filed in court. Of 26 rape cases, only six were filed. In the case minors, the ratio was nine of 34 rape cases ending up in court.

    Nicole, at least, braved cross-examination and the harsh glare of the media spotlight, including the baring of her real identity name.

    She mustered the strength for this because many of us supported her – whether because rape alone was enough to stir us to outrage or because she was a vehicle to reach a higher goal.

    And now she has crumbled. Why are we so irate? How many friends do we know who voluntarily joined this or that cause but dropped out after sometime? Do we sneer and call them traitors? Don’t we even share meals with those who now serve the government, no matter if the thought of this government makes us puke?

    How many on Facebook were once firm believers in this or that cause? Nobody pressured us to join those causes, right? Did we face a mob when we decided to leave?

    Well, Nicole never volunteered for the cause. She had to be raped to join it. She never asked to be poster girl for nationalists; she was made one by virtue of rape.

    There are a million and one reasons for despair and hopelessness. A noble cause cannot always hold one above the waters. Nor will a lynching make our cause more right.

    Nicole is not the enemy. Let’s not treat her like one.

    Hindi ko maintindihan kung bakit pinapaikot-ikot ng Gabriela at Ursua ang issue at sinasabing biktima kasi si Nicole ng justice system ng Pilipinas kaya nag-recant, napakalinaw na ginagawan pa ng spin ng mga napahiya, nag-convict kasi ng inosente kaya panindigan na lang ang pagkakamali at gawan ng spin ang istorya. Walang ibang biktima dito kungdi si Daniel Smith, he was wrongfully convicted, yang Ursua, Legarda at Gabriela na yan saving face na lang dahil napahiya. Makonsensya sana kayo, may balik ang karma!     Perhaps Daniel Smith can retrieve the P100,000 he paid to Suzette Nicolas. He ought to be released as well so he can move on with his life. I'm not sure if he can sue her for what she put him through - but knowing the Philippine (in)justice system, it might not be worth the pursuing any legal remedies.

    Haaay Pilipinas, when will you wake up and implement reforms. When will the Catholic church take responsibility for the colossal moral failures of Philippine society (most corrupt in Asia for 2 years in a row - and the church is strangely silent on this dubious distinction).

    Will we Filipinos ever see the day when good will finally prevail over the overwhelming corruption that seems to define our past and present history?

    Bash Ateneo all you want (and while you're at it don't forget to include that insipid Atenean Tracy Isabel Borres), but Ateneo is not just the problem. Our political elites are also educated at La Salle & UP Diliman (Romulo Neri is from Diliman).

    Yes, there is a lot missing from this article. This was a
    highly celebrated case that was followed by the local media for months in the Philippines. It mobilized womens/human rights groups and divided sectors of Filipino Society along party lines, ie progressives vs conservatives who were more concerned about straining
    US-RP relations than seeking justice in a rape case.

    Finally, after DNA evidence against Cpl Smith became indefensible, he was found guilty and sentenced. That
    sentence was never carried out because of the VFA agreement between the US and the Philippines...

    This is hardly enough evidence for an overturning of a conviction. My wife has worked with domestic violence and sexual assault victims and it is quite common for those who have experienced sexual assault to blame themselves for "leading" the perpetrator on or other such things. The quotes in this article show a woman exhibiting a tentativeness in her statements that are being characterized as "changing the story" that is common for those who have been through such an experience. This sadly common occurrence is a result of a number of factors such as culture and societal norms that serve to blame women for being assaulted though it was not their own fault. That this sexual assault was even reported in uncommon enough, plenty of evidence has shown that sexual assault is severely under-reported no matter what the social class in our own and many many other "modern" countries. just look at one of the other stories to come out today about the surge of sexual assaults in our own military!

    Despite her (partial) "recantation" (it wasn't so much a recantation as a statement saying how she could see D. Smith getting the wrong idea)- it seems highly implausible that accuser would be so willing to have sex in a van w/ THREE other men looking on (in fact, it's much more plausible that the 3 other egged D. Smith to go further than he should have).

    The fact that the woman is now living in the US makes one really question her motive in trying to make D. Smith more sympathetic (really, it doesn't matter if a guy thinks a girl is amenable to sex b/c he is on a "date"; if a girl says no or is too inebriated to give proper consent, then it is sexual assault).

    Thanks for going out of your way to find a rape victim who "lied" NYT. I won't hold my breath waiting for an article on the number of women who never report their rape or the number of rapes that are never prosecuted because the DA doesn't think a jury will convict a guy if the women was drinking or not beaten etc.

    If the women didn't want to have sex, she was raped. IT DOESN'T MATTER IF SHE WAS A PROSTITUTE who took a guys money and then said stop in the middle of sex and he didn't.

    Any guy who thinks a woman wants to have sex with him WHILE HIS FRIENDS EGG HIM ON, needs to put down the porn and get help.
