Judge Jorge Emmanuel Lorredo is claiming that MalacaƱang is pressuring him to inhibit from hearing Lozada's case and that it is planning to use the perjury case to declare martial law.

Wow! This really sounds fantastic and it is surprising that a judge should be issuing such statements. It tends to give an impression that he has already made his mind up about the case he is hearing.

This comes after Lorredo said that he may summon President Gloria Macapagal Arroyo to his court. In doing so, perhaps he wants to make the impression that he can actually compel the President. Then again, considering that the President is immune to civil and criminal suits, this may just be Lorredo's way of saying that he would like PGMA to drop by and visit. Hmmm... All speculations aside, I think the President would be well advised not to attend.

For some reason, after learning of these pronouncements from Lorredo, the name of Judge Florentino Floro Jr. and his “dwarf” friends/consultants come to mind. People are entitled to their quirks aren't they? Some who are like Floro may favor consulting “dwarfs” before rendering a decision. In Lorredo's case, some may be partial to issuing provocative statements – but to what effect?

While judges are supposed to be insulated from the influence of the media, they are but only human and some may even crave a bit of limelight. Perhaps Lorredo enjoys attention and perhaps getting it will boost his profile. Perhaps h Lorredo just wants to plant an elbow in the rib of one of his Panyeros and say, "Sikat na ako!" Or perhaps, Lorredo may be eying an appointment to a higher position and that's why he is consistently courting the eye of Malacanang.

Even a well known name in the blogosphere made a big deal about Judge Lorredo getting somewhat of a kick from the comments posted there, basically supporting him at a time when he is being ridiculed. I wonder if, say, Judge Floro would say the same thing and get the same treatment from the pre-eminent blogger.

No matter what his motive may be, Judge Lorredo is getting the attention he wants but it certainly isn't the kind of attention that would later make for a “Supreme Court Justice Narvasa” or a “Supreme Court Justice Reynato Puno.” Judges must build their reputation on fairness and impartiality. However, in the eyes of many people, Lorredo's recent actions may show early inclinations of being just the opposite.

Why risk being hauled to the Supreme Court for a possible violation of ethics and face the possibility of sharing the same fate of Floro?

In this whole hullabaloo over Jun Lozada, many may believe in the saying that “the enemy of my enemy is my friend” -- but do not fall into this trap and be fooled!

Jun Lozada is no friend to those who are seek the truth and an end to corruption in government. We must remember that Lozada did not volunteer the truth. Rather, he was forced to squeal in order to save his own ass! Lozada, was in fact, an integral part of the corruption being perpetrated... he had more than just one reason to keep quiet. It was only after he has found out and compelled (or perhaps plied with a promise of ample rewards) that Lozada finally surfaced, albeit quite reluctantly.

Lozada's tears, bawling, and other plays at ad miserecordiam must have blinded and/or brainwashed people into forgetting that among those hauled to the Senate for the NBN ZTE probe, it was only Lozada who admitted to pilfering money from the Philforest corporation. Did we forget about the tape of someone who sounded like Jun Lozada and someone who sounded like Joey De Venecia talking about a how much money was up for grabs in the NBN ZTE deal? Puh-leez!

Despite this, let's not forget that when Lozada did surface after hiding out in Hong Kong, he was indeed whisked off by a number of men. Being in a frazzled state, perhaps Lozada wasn't sure if these men were protecting him or kidnapping him? But one thing is for sure, Mike Defensor wasn't among those men.

To be accused of defending a corrupt President is one thing - but to be accused of kidnapping is another thing all together. Mike Defensor is entitled to all legal remedies under the law and he has tactfully exercised this right.

All things considered and given how Judge Lorredo has been behaving as of late, perhaps it would be best for Defensor and Lozada to have their case heard by another judge.

Hmmm... Perhaps, that is Lorredo's real objective.

I am disappointed with Manila RTC Judge Emmanuel Lorredo, the son of OB founder and Magsaysay political operative Jorge Lorredo, Jr., who was considered one of the most active and articulate community organizers of his day. Judge Lorredo, who is hearing the perjury case filed by former DENR secretary and presidential chief of staff Mike Defensor against self- styled “truth seeker” Jun Lozada, did not do justice to his father’s memory with his verbose, struggling, and off- the-mark order in who is hearing the perjury case filed by Defensor on the petitions for custody pending before his sala. The Judge Lorredo I know is a man of action, not verbose, a straight and inspiring talker, not a rambling, snaking operative. If we go by his order, Judge Lorredo is the exact opposite. Sayang.

To have a window into Judge Lorre-do’s standing I am giving space to portions of that order which was emailed to the Ateneo de Manila HS 66 Yahoo Group. Some legal luminaries have described the same as rambling, sneaky, injudicious, 0and out of bounds. Let Lorredo’s words speak for himself:

Catholic priests and nuns as well as members/leaders of other religious groups are welcome... to participate in the court’s morning prayer before the start of the court session. The Supreme Court encourages judges to start court sessions with a prayer.

As I have said during the hearing of accused’s motion for release on recognizance which, by the way, I promptly denied, Mike Defensor should have been there so that I could help him and accused settle their differences. After all, the Supreme Court encourages judges to help parties arrive at an amicable settlement.

Why is it safer for Defensor to settle the case... Defensor admitted on TV that this perjury case he is pursuing against Lozada is very bad for his political career. I fully agree with him.

Furthermore, I say that it may be very bad for his health and his family as well. If he gets sick like Mike Arroyo, would not that be bad for him and his family? The Presidents that I have known are only Presidents Marcos, Aquino, Ramos, Estrada and Arroyo. My observation is that of all the presidential spouses, Atty. Mike Arroyo is the one who is very sickly. He has a serious heart disease. He even tries to make us believe that he is in no condition to attend to Senate probes.

There are those who say that the serious heart disease is some kind of punishment for Atty. Mike Arroyo. I do not know if this is true for I do not really know how our Lord works for He does works in mysterious ways. But what I do know is Lozada is protected by the church, by the priests and nuns. That must mean something. Defensor, take note: that must mean something. Now why are all these so important for Defensor to ponder on. Simple. If it is true that Mike Arroyo is being punished, Defensor may also be punished with some serious disease. I am sure his loved ones do not want that to happen to him.

Whew!! What an order, and we are just in the beginning. How Mike Arroyo got into this order is really troubling; for a judge to say those things about petitioner Defensor even more so... Is he not supposed to look dispassionately at the facts, avoid extraneous matters, and judge in accordance with his best lights??? He is definitely off his rocker. Then, he takes off on another peroration.

Why this case is not to the best interest of the first couple. Since Defensor is not a trial lawyer, he apparently has not seen the very explosive potential of this case: the first couple (Gloria and Mike Arroyo) may validly and legally be dragged into the proceedings by Lozada’s defense team. All that the defense team has to do is invoke certain provisions of the Rules of Court. As a fair and impartial judge, I shall have no reason not to grant such request.

It is true that evil, cruel and vindictive regimes can use the law to make their enemies suffer. But it is that same set of laws that can enable the oppressed to fight back. Such is the beauty of the law that is why many have fallen in love with the law. As a child I have dreamed of one day becoming a judge to apply the law not to destroy lives but to make lives better. Now, I am in that position with the help of God I dispense justice everyday with the aid and guidance I always seek from our Lord.

If there is a motion to present President Gloria or First Gentleman Mike Arroyo as hostile witnesses in order for accused Lozada to establish I will not hesitate to issue the corresponding subpoena compelling the First Couple to testify as hostile witnesses for the defense. If Gloria and Mike refuse to obey the subpoena, I will not hesitate to issue warrants of arrest against them because it is the constitutional right of Lozada to have the best possible defense. And it is my duty as trial judge to see to it that there is due process in my court. And so on and on and on.

Judge Lorredo even went to the extent of sugessting that if the police officers refuse to serve the warrants against the First Couple then he will deputize other public officials (he named Mayor Lim and Senator Lacson as such deputies given their police experience so they can “arrest, handcuff, and put behind bars any fugitive.) Then, he posits the question: They are no match against the PSG and proceeds to answer his question, saying: “What if Senator Trillanes and his comrades join the mission to arrest? Get the picture Mr. Railroadman Defensor? Defensor, just imagine how powerful a message that would be for our people and the whole world. And just imagine how that could affect the First Couple.”

Towards the end of the May 4 order, Lorredo summons the memory of his father (who is now with Jesus in heaven watching me with a smile on his face) and requests for prayers so that he “will always be a good, humble, God-fearing and very wise judge... and that he may be elevated from a judge to a justice (even though I do not have any political backers.) Double Wow!!! How did Judge Lorredo ever got to sit in the bench with such an order. You be the judge....

  36. trixie Says:

    Dear Paul,
This piece seems well written. Though for the most part, I disagree, largely on legal points.

Mike's case is based on his premise that he had been damaged by Jun Lozada's statement given in evidence in the Court of Appeals on his petition for the issuance of a write of amparo. In my own opinion, Mike could not have been damaged, considering that the Court of Appeals did not give much weight to Lozada's statement and therefore refused to issue the protective writ.

True that the Lozada affidavit forms part of the records of the case, but, having been given short shrift by the appeals court, does not seem to bear much weight. By filing the case, Mike gives too much importance to a matter trivialized by the court.

Since the case rests on such a thin premise, I think Judge Lorredo treated it as farce, broadly playing the pseudo-villain to Mike's dramatic premise.

I'm not saying that Judge Lorredo acted in a manner befitting the judiciary -- that is a matter the Supreme Court appears to have acted on. What I am saying is you reap what you sow. A farce of a case, deserves a heavy dose of irony in return.

Just my opinion, and as Amiel says, "wag magagalit!"

By the way, how is First Quadrant -- are the investors still getting any of their promised income?

Ms. Ellen Tordsillas has just released a VERA FILE report containing the order of Judge Jorge Emmanuel Lorredo "ORDERING" Mike Defensor to desist from pursuing his libel.

Common Atty.Trixie Angeles, where can you read a judge's order in a language so pedestrianized and insolent? In the tabloids like BULGAR?

Excerpts of Judge Loredo’s Ridiculous Order to Mike Defensor:

As I have said during the hearing of accused’s motion for release on recognizance which, by the way, I promptly denied, Mike Defensor should have been there so that I could help him and accused settle their differences. After all, the Supreme Court encourages trial judges to help parties arrive at an amicable settlement.

    .../...

Hence, I have decided to include those words in this order for Defensor to ponder on. I hope that Defensor would be able to clearly so that on May 7, 2009 (accused’s arraignment), there could already be peace between him and Lozada.

Why is it safer for Defensor to settle the case—

Defensor has admitted on TV that this perjury case he is pursuing against Lozada is very bad for his political career. I fully agree with him.

Furthermore, I say that it may be very bad for his health and his family as well. If he gets sick like Mike Arroyo, would not that be bad for him and his family?

    .../...

My observation is that of all the presidential spouses, Atty. Mike Arroyo is the one who is very sickly. He has a serious heart disease. He even tries to make us believe that he is in no condition to attend Senate probes.

    .../...

There are those who say that the serious heart disease is some kind of punishment for Atty. Mike Arroyo. I do not know if this is true, for I do not really know how our Lord works, for He does works in mysterious ways. But what I do know is that Lozada is being protected by the Church, by the priests and nuns. That must mean something. Defensor, take note: that must mean something.

    .../...

When it is the turn of the defense to present evidence, I will also allow the defense every opportunity to raise reasonable doubt or to destroy each and every element of the felony of perjury.

And if there is a motion to present president Gloria or first gentleman Mike Arroyo as hostile witnesses in order for accused Lozada to establish, I will not hesitate to issue the corresponding subpoena compelling the first couple to testify as hostile witness for the defense.

If Gloria and Mike refuse to obey the subpoena, I will not hesitate to issue the warrants of arrest against them because it is the constitutional right of Lozada to have the best possible defense. And it is my duty as trial judge to see to it that there is due process in my court.

If the police officers refuse to serve the arrest warrants because Gloria is their boss, then I will be forced to deputize other public officers to serve and implement the arrest warrants.

I need not search hard nor should I wait long, for Manila Mayor Lim and the many senators who wish to take Lozada into their custody may move that they be deputized. Some of these people are lawyers, some of them have extensive police experience, like Mayor Fred Lim and Senator Ping Lacson. They can arrest, handcuff and put behind bars any fugitive.

They are no match against the PSG, the Presidential Security Group? What if Sen. Trillanes and his comrades join the mission to arrest? Get the picture, Mr. Railroadman Defensor?

Are this the actions of a sane judge, Atty. Angeles?

  68. isafp Says:

hahaha.... I think Amiel is winning this one- AGAIN!

  69. Anonymous Says:

What is essential is invisible to the eye. There is a message the judge is trying to convey, that our justice system is a farce. If Amiel and the other pseudo intellectuals can't see this, they're blind and downright morons. Moronic enough to insist on defending Mike...Amiel might as well wear "Mabuhay si GMA!" on his shirt! Why all the misdirection Amiel? Whats your 30 pieces of silver? You're degree of intelligence is as shallow as your "sosyalan" tabloid comments disguised as witty blog posts.
Another "good writer" but apparently illiterate...

  70. Anonymous Says:

I believe Amiel's powers of observation are infinitely superior to all of us. He can detect any quirk from anyone faster than you can say "hitachi!" - hilabtanon, tabi-an, chismoso in bisaya (go figure).
I will not be surprised if one day we will be buying a book written by him in the tradition of Salman Rushdie's "Satanic Verses" perhaps entitle "Moronic Verses" - a compilation of bloopers, fiascos, or whatever - of Philippine politics' personalities.
I have nothing personal about Mike Defensor. Except the fact that he is too wimpy, too puny, he has these weak look in his eyes, and instead of "speak softly but carry a big stick" he talks too much and carries a small stick (and its not just performance that counts).
    Be gentle on Mike guys...

    Yours truly,
    Julie

I doubt that Amiel will ever wear Mabuhay si GMA!

But I have reasons to believe that if it comes down to that -- he will wear a sleeve that says Mabuhay si Mike.

Amiel knows Mike D inside and out, beyond what any of you, and us, can see. I don't think it is because of his friendship with Mike that Amiel chooses to be blind to Mike's faults. On the contrary, it is because of his friendship with Mike that Amiel sees clearly and thoroughly.

I had several debates with Amiel about Mike, but you can never shake the stability of friendship. It is this friendship that gives Amiel access to Mike inner thoughts and, when necessary, influence the secretary.

This might be a cliche, but administrations come and go, political careers have a life span, but friendships, the genuine ones not those hatched in political agenda, are meant to last a lifetime.

  72. If I were to put it bluntly:

Face it, our country's in shambles.

  73. marines ako Says:

Hoy, its so typical of Amiel to twist other people's words. Even the words of his own co-writer in victorina. Hahaha. Ang dasbi nga ni trixie, she isn't defending Lorredo dahil na kastigo na siya ng Supreme Court.
Amiel, your bias for Mike Defensor is showing. Pati kasamhan mo dito sa victorina itutumba mo para sa kanya!

  74. pedro Says:

    Sabi ni Trixie:
"I'm not saying that Judge Lorredo acted in a manner befitting the judiciary -- that is a matter the Supreme Court appears to have acted on. What I am saying is you reap what you sow. A farce of a case, deserves a heavy dose of irony in return."
Mga tanga kayo. Pati kasamahan ninyo pinagagalitan ninyo, kahit nag-agree sa inyo!

  75. trixie Says:

    Amiel,
Didn't I just say that I won't comment on Judge Lorredo's manner, because the Supreme Court already stepped in? You're barking up the wrong tree. I never commented on Lorredo, much less take his side. Cool ka lang.

    Rain,
I would not have advised Mike to file this case because it is too thin. He has to prove damage and malice, difficult enough under ordinary circumstances. But as I said again, its only an opinion. Clearly neither Amiel, nor Mike agree.
    Peace.

  76. trixie Says:

O, and Amiel and Rain, forgot to add, that I would not have filed this case, because it gives Jun Lozada a platform again. If you think that his histrionics are hysterical, then Mike's case was precisely what opened the floodgates. Even from a public relations perspective, filing the case was a mistake-- especially since Mike hismelf is not around to defend himself.

  77. Paul Says:

The pressure must really be getting on Judge Lorredo's nerves.

Faced with a similar conundrum, I'd probably go mad.

  78. Annie Reyes Says:

Statement of Chiz Escudero on Jun Lozada

I cannot blame Rodolfo “Jun” Lozada for rejecting an amicable settlement of the perjury case filed against him by former presidential chief of staff Michael Defensor.

The former secretary has refused to heed my call for him to withdraw the complaint. Let us therefore leave the court to decide on the merits of this case without pressure from any source.

I call on the Palace to drop all other complaints aimed at harassing Jun Lozada and his wife. They and their children have suffered long enough.

I urge Jun Lozada to remain steadfast in his fight against corruption and abuse of power in high places. The truth will out and it will set him free.

this article is "burning too many bridges". it may end up with no one left standing. please refrain from being waylaid by emotions.. stick to the issues and an objective and healthy exchange of ideas will reign supreme. personal attacks to comments that are not aligned with one's views to the extreme might lead to lost friendships; at the very least result to unneccesary frayed nerves. btw where in the world is plaintiff mike defensor? will he just let pass the scrubbing did to his person by judge lorredo? or is he just content to let others take the cudgels for him. if such is the case, is it fair to friends who will "die" for him?

  84. Anonymous Says:

I believe Amiel's position is admirable. He's a good friend, and if he has to take a bullet for Mikem he probably will...well, its that time of the year when Amiel has to take the bullet, take it and suck it up for there's more to come...

    late reply:

Amiel; YES he may be making a mockery of the court but for me i think he is making a mockery of the whole justice system of the Philippines.

Maybe he needed to go down to the level of cussing words to be able to get his points across among THOSE who have no RESPECT for our Justice because MONEY have allowed them to afford presence and use of the system to their own advantages.

it might be infantile on his honoured profession but i have always believed that SOMETIMES you needed to go down with fleas to release your fleabomb efficiently.

I however ADMIRE your loyalty. I am in AWE. You are in a much better position to see the real character of your friend.

Some of us who are mere bystanders of this saga can only ascertain so much from afar. BUT as much as I wouldn't like to judge I can SMELL something fishy from the actions of your friend Mike D. Not only because he has connections with the Pandak (that word again) but his actions are questionable to put it mildly.

Some people may judge you by your associations with your friend BUT I do not. You are a far better person than some people would like to believe. The saying that "birds of a feather......" IS NOT ALWAYS TRUE.

AND FOR THAT i SALUTE YOU and the victorina council. PEACE

  98. bokasi Says:

    Let's summarize, shall we?
    Lozada squealed.
Lozada is corrupt, but he squealed what is generally agreed as the truth.
Mike D and Amiel are BFF, but that's irrelevant to the bigger picture. Amiel's loyalty even less so.
Lozada is Chinese by blood but he is technically Filipino.
If you insist he's Chinese, go discuss that with Jiang Zhemin.
    The Chinese are effing corrupt.
The Filipinos are at least equally or effinger corrupt.
We are in the Philippines; let's run after the effing corrupt we have jurisdiction over - the Filipinos.
Lozada's corruption is peanuts compared to those above him.
So why don't we unleash our energies on that, instead of these all-caps cussing that don't make sense, don't lead to anywhere, don't contribute to the discussion and don't win you any readers?
Nobody's asking you to sleep with Lozada, but it's reasonable for the country to expect you to use you smarts to fight for what is right and good for the country.
Now can i please have my 200 million?

  99. Anonymous Says:

bokasi... I think the point is Lozada should first return what he stole before trying to be a martyr. At least Mike does not claim to be one. Only then can he be a credible witness- WHEN HE SAYS THE WHOLE TRUTH AND NOTHING BUT THE TRUTH!
